ORDER

WHEREAS on August 25, 2022, the Capital Markets Tribunal held a hearing by videoconference;

ON HEARING the submissions of the representativesfor Staff of the Ontario Securities Commission (Staff) and for each of the receiver of Bridging Finance Inc., David Sharpe, Natasha Sharpe and Andrew Mushore (the Respondents);

IT IS ORDERED THAT:

  1. by 4:30 p.m. on October 14, 2022, the Respondents shall:

    1. confirm that there are no outstanding issues with respect to disclosure;
    2. or, if disclosure issues have been identified, then either:
      1. the parties shall file a joint schedule setting out the steps for the resolution of disclosure issues; or
      2. if there is no agreement, the parties shall serve and file brief submissions in writingwith a proposed schedule;
  1. by 4:30 p.m. on October 28, 2022, the Respondents shall:
    1. serve and file a witness list;
    2. serve a summary of each witness’s anticipated evidence on Staff; and
    3. indicate any intention to call an expert witness, including providing the expert’s name and the issues on which the expert will give evidence; and
  1. a further attendance in this matter is scheduled for November 28, 2022, at 10:00 a.m., by videoconference, or on such other date and time as may be agreed to by the parties and set by the Governance and Tribunal Secretariat.
