In this enforcement case, the OSC alleges that Nayeem Alli did not comply with the Tribunal’s earlier order that he not be a director or officer of any company.

Alli filed documents for a motion and for the hearing on the merits, sanctions and costs. The OSC asked the Tribunal to strike (remove from the record) parts of those documents. It says those parts refer to settlement discussions between Alli and the OSC. The OSC says those discussions are confidential and cannot be used at the hearing because of settlement privilege.

Alli says that those parts only mention that settlement discussions happened and don’t say what was discussed.

The Tribunal decided that references to the content of settlement discussions must be removed from the record. However, references that only say settlement discussions took place do not have to be removed.
