ORDER
(Subsection 17(1) of the Securities Act, RSO 1990, c S.5, subsection 2(2) of the Tribunal Adjudicative Records Act, 2019, SO 2019, c 7, Sch 60, and subrule 8(4) of the Capital Markets Tribunal Rules of Procedure)
application by the Ontario Securities Commission for an order authorizing the Commission to disclose the transcripts of examinations of David Sharpe, Natasha Sharpe and Andrew Mushore conducted pursuant to section 13 of the Securities Act (the Act), and the exhibits used in those examinations, to the Ontario Superior Court of Justice in response to a Criminal Subpoena issued by Justice Sugunasiri on May 11, 2026, and in accordance with the Ruling of Justice Sugunasiri in R v Ng, SCJ Court File No CR-23-00000352-0000 dated May 29, 2026;
ON READING the materials filed by the parties;
IT IS ORDERED, for reasons to follow, that:
- under s. 17(1) of the Act, the Commission is authorized to disclose to the Ontario Superior Court of Justice the compelled examination transcripts of David Sharpe, Natasha Sharpe and Andrew Mushore, and the exhibits referred to in those transcripts; and
- under subsection 2(2) of the Tribunal Adjudicative Records Act, 2019, and subrule 8(4) of the Capital Markets Tribunal Rules of Procedure, the transcripts and the exhibits, and the adjudicative records of this proceeding are confidential and shall not be disclosed to the public, unless a Court or this Tribunal orders otherwise.
