ORDER
WHEREAS on September 18, 2026, the Capital Markets Tribunal held a hearing by videoconference, and considered a request from Daniel St-Jean that he be permitted to participate in the merits hearing in this matter by videoconference, and a request from all parties that certain of their witnesses be permitted to participate in the merits hearing by videoconference;
ON HEARING the submissions of the representatives for the Ontario Securities Commission and for the respondents;
IT IS ORDERED, for reasons to follow, that:
- pursuant to rule 9 of the Capital Markets Tribunal Rules of Procedure (Rules):
- the merits hearing in this matter will take place at the Capital Markets Tribunal located at 20 Queen Street West, 17th Floor, Toronto, Ontario, as previously ordered;
- Daniel St-Jean is not required to be physically present in the hearing room during the merits hearing and may participate by videoconference; and
- the witnesses identified by the parties are not required to be physically present in the hearing room and may participate by videoconference;
- pursuant to rule 33 of the Rules, a confidential conference is scheduled for October 2, 2026, at 10:00 a.m., by videoconference, or as may be agreed to by the parties and set by the Registrar;
- by 4:30 p.m. on September 28, 2026, the Commission shall serve and file written submissions for the confidential conference;
- by 4:30 p.m. on September 30, 2026, the respondents shall serve and file written submissions for the confidential conference;
- by 4:30 p.m. on October 13, 2026, the parties shall provide to the Registrar electronic versions of their books of documents containing the documents that each party intends to rely on or enter as evidence at the merits hearing;
- by 4:30 p.m. on October 13, 2026, the Commission shall serve and file any affidavit evidence that it intends to rely upon at the merits hearing;
- the requirements in rule 29 of the Rules are waived and do not apply to the Commission’s affidavit evidence;
- the exhibits to any affidavits shall be filed in separate folders and need not be included in bookmarked PDF volumes, and all exhibits shall be identified in the affidavits by their document ID and hyperlinked so that each exhibit can be individually accessed; and
- the parties shall test in advance that the formatting of the affidavit evidence makes the exhibits accessible by the Tribunal and all parties.
