In this enforcement proceeding, OSC staff alleges that Oscar Furtado and companies he controls defrauded investors, and that he misled staff when he was questioned during their investigation.

In an earlier decision the Tribunal adjourned (delayed) the start of the hearing of the merits of staff’s allegations against Furtado from August 21 to November 3, 2023, at Furtado’s request. In a separate decision the Tribunal denied a request from Furtado for a further six month delay of the start of the hearing. 

Furtado again asked the Tribunal for a six month delay of the start of the merits hearing. He says he is unable to prepare for or participate in the hearing due to ongoing health issues. Furtado provided a report from a qualified psychiatrist in support of his request. OSC staff did not oppose Furtado’s request to delay the start of the hearing. 

The Tribunal decided that Furtado gave them enough medical evidence to show that his health issues justify delaying the start of the hearing. The Tribunal delayed the start of the hearing from November 3, 2023 to July 8, 2024.

Furtado asked that the psychiatrist’s report be kept private. Staff says that even if the whole report is not available to the public, certain details of the report should be public to help people understand the Tribunal’s decision. 

The Tribunal decided that the parts of the report that provide context for the psychiatrist’s conclusion and do not discuss Furtado’s personal information should be public.
