The merits hearing in this enforcement case is scheduled to take place in person over eight days at the Capital Markets Tribunal offices in Toronto. Daniel St-Jean expects to represent himself and the corporate respondents.
St-Jean asked the Tribunal to allow him to participate in the hearing by videoconference, instead of in person, because of health and financial concerns. He is 76, was advised by his doctor to avoid the stress of driving on busy highways, lives far from Toronto, and cannot afford the costs associated with commuting for the hearing.
The OSC says St-Jean should participate in person, at least on the days that he testifies. The Tribunal’s rules of procedure expect a person to participate in person when testifying, and there are advantages to parties and witnesses participating in person.
The Tribunal found that St-Jean’s concerns outweighed the advantages of him participating in person and decided that he can participate effectively by videoconference.
